This essay answers two questions that continue to drive debate in moral and legal philosophy; namely, ‘Is a risk of harm a wrong?’ and ‘Is a risk of harm a harm?’. The essay’s central claim is that to risk harm can be both to wrong and to harm. This stands in contrast to the respective positions of Heidi Hurd and Stephen Perry, whose views represent prominent extremes in this debate about risks. The essay shows that there is at least one (...) category of risks – intentional impositions of risk on unconsenting agents – which can be both wrongful and harmful. The wrongfulness of these risks can be established when, on the balance of reasons, one ought not to impose them. The harmfulness of these risks can be established when the risks are shown to set back legitimate interests. In those cases where risks constitute a denial of the moral status of agents, risks set back agents’ interest in dignity. In these ways, the essay shows that there are instances when a risk can constitute both a wrong and a harm. (shrink)

El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. This essay focuses on anthropomorphism as both a form of hype and fallacy. As a form of hype, anthropomorphism is shown to exaggerate AI capabilities and performance by attributing human-like traits to systems that do not possess them. As a fallacy, anthropomorphism is shown to distort moral judgments about AI, such as those concerning its moral character and status, as well as judgments of responsibility and trust. By focusing on these two dimensions of anthropomorphism in AI, the essay highlights negative (...) ethical consequences of the phenomenon in this field. (shrink)

This work shows that two problems—the reference class and the mental state of the agent—undermine the plausibility of the ‘blameworthiness tracks risk thesis’ (BTRT), which states, prima facie, an agent is more blameworthy for imposing a greater rather than smaller risk. The article first outlines core concepts. It then shows how the two problems undermine BTRT; namely, (1) no blame attribution based on risk imposition is unequivocal; (2) when the materialization of risk is subject to chance, an agent’s decision can (...) ground an equal degree of blameworthiness regardless of whether the risk is greater or lesser. Disagreeing with Jerrold Levinson's claim that being conscious of broad-span musical form is not essential to understanding music, I will argue that our awareness of musical architecture is significant to achieve comprehension. I will show that the experiential model is not incompatible with the analytic model. My main goal is to show that these two models can be reconciled through the identification of a broader notion of understanding. After accomplishing this reconciliation by means of my new conception, I will close (...) the paper by discussing some reasons to accept an enhancing notion of musical understanding that includes levels and degrees of understanding. /// En desacuerdo con la afirmación de Jerrold Levinson: que ser consciente de la forma musical a gran escala no es esencial para comprender la música, sostendré que nuestra conciencia de la estructura musical es significante para alcanzar comprensión. It appears at least intuitively appropriate to claim that we owe it to victims to punish those who have wronged them. It also seems plausible to state that we owe it to society to punish those who have violated its norms. However, do we also owe punishment to perpetrators themselves? In other words, do those who commit crimes have a moral right to be punished? This work examines the sustainability of the right to be punished from the standpoint of the (...) two main theories of rights—the will and the interest conceptions. The right to be punished is shown to be largely indefensible on both accounts: on the will theory, the right to be punished conflicts with autonomy, and it can neither be claimed nor waived by a perpetrator; on the interest theory, a perpetrator’s interest in punishment, inasmuch as it exists, is not sufficient to ground a duty on the part of the state. The contribution of recent theories of sound and audition has been extremely significant for the development of a philosophy of auditory perception; however, none tackle the question of how our consciousness of auditory states arises. My goal is to show how consciousness about our auditory experience gets triggered. I examine a range of auditory mental phenomena to show how we are able to capture qualitative distinctions of auditory sensations. I argue that our consciousness of auditory states consists in having thoughts (...) that organize our experience. Although my proposals could be adapted to fit with other theories of consciousness, here I expand David Rosenthal’s high-order-thought theory and his quality-space theory, and show their usefulness for analyzing our auditory experience. I use quality-space to account for pitch, timbre, loudness, and sound location. I further show that our high-order-thoughts capture qualitative aspects of our auditory sensations. I conclude by demonstrating how a hypothetical listener in possession of a refined vocabulary describes and reports her high-order-thoughts about her musical experience. (shrink)

Several contemporary philosophical theories of introspection have been offered, yet each faces a number of difficulties in providing an explanation of the exact nature of introspection. I contrast the inner-sense view that argues for a causal awareness with the acquaintance view that argues for a non-causal or direct awareness. After critically examining the inner-sense and the acquaintance views, I claim that these two views are complementary and not mutually exclusive, and that both perspectives, conceived of as modes of introspective access, (...) actually broaden the notion of introspection. I then propose a useful distinction between stimuli-induced introspection—i.e., a receptive process whereby some specific mental states induce introspection—and self-triggered introspection—i.e., a selective process whereby the individual’s own interest and volition initiates introspection. I argue that that distinction may eliminate the false dichotomy which claims that only one of those types of awareness, either the causal one or the direct one, is conducive to introspection or is defined as introspection. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' In this paper I respond to Bird´s objections.

In disagreement with Claudia Baracchi’s controversial thesis that there is a “simultaneity and indissolubility” if not an “identity” of intelligence (nous) and perception (aisthēsis) at the core of Aristotle’s philosophy, I will argue that Aristotle maintains a fundamental distinction between these cognitive faculties. My goal in this paper is to examine specific parts of two central and complex passages, VI.8, 1142a12-30 and VI.11, 1143a33-b15, from the Nicomachean Ethics to show that Baracchi’s view is unpersuasive. I will show that Aristotle considers (...) nous to be a different capacity than mere perception and one through which particulars and indemonstrable principles become intelligible. Moreover, I will show that Aristotle considers that the objects of nous differ in kind from those that sensation (our senses) and perception (inference from our senses) grasp. After examining critically Baracchi’s thesis in light of a close reading of those two relevant passages, I will conclude the paper by showing the significance of Aristotle’s claim that a state is defined in terms of its objects of apprehension for understanding the distinction between nous and aisthēsis. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Higher-order theories of consciousness typically account for introspection in terms of one's higher-order thoughts being conscious, which would require a third-order thought — i.e.a thought about a thought about a mental state. In this work, we offer an alternative account of introspection that builds on the recent HigherOrder Representation of a Representation (HOROR) theory of phenomenal consciousness. According to HOROR theory, phenomenal consciousness consists in having the right kind of higher-order representation. We claim that this theory can be extended to (...) introspection by recognizing that there is a distinctive kind of consciousness — i.e. introspective consciousness — which can be accounted for as the theory does for phenomenal consciousness generally. We call this novel view: Higher-Order Representation Intentionally For Introspective Consciousness (HORIFIC). We argue that there are independent reasons for thinking that introspective consciousness can be either 'stimuli-induced' or 'self-triggered' and that one of the benefits of the view we develop is that it can embrace a pluralist approach. Our view also accounts for what specific mental state is represented by a particular higher-order representation, and for the way in which we are aware of changes, transitions, and boundaries between mental states in specific cases of introspective consciousness. Recently, the construct ‘lucid dreamless sleep’ has been proposed to explain the state of ‘clear light’ described by Tibetan Buddhist traditions, a special state of consciousness during deep sleep in which we’re told to be able to recognise the nature or essence of our mind (Padmasambhava & Gyatrul, 2008; Ponlop, 2006; Wangyal, 1998). To explain the sort of awareness experienced during this state, some authors have appealed to the sort of lucidity acquired during lucid dreaming and suggested a link between (...) both phenomena (Thompson, 2014, 2015; Windt, 2015a; Windt et al., 2016). Whilst these authors appeal to a non-conceptually mediated form of lucidity, which doesn’t consist of reflective awareness and propositional thought, the question as to whether the state of clear light should be considered a lucid state similar to lucid dreaming still arises. I argue that the concept ‘lucidity’ used to describe this sort of state is imprecise and that two theoretical notions of lucidity should be distinguished. The first one, which I call the technical notion, requires the recognition of the hallucinatory character of my current experience. The second, the broader notion, involves the seeming recognition of being directly acquainted with the phenomenal character of my experience. I spell out these two notions of lucidity and argue that only the latter could apply to the state of clear light sleep. (shrink)

This paper presents a pilot study that explores instances of objectless awareness during sleep: conscious experiences had during sleep that prima facie lack an object of awareness. This state of objectless awareness during sleep has been widely described by Indian contemplative traditions and has been characterised as a state of consciousness-as-such; while in it, there is nothing to be aware of, one is merely conscious (cf. Evans-Wentz, 1960; Fremantle, 2001; Ponlop, 2006). While this phenomenon has received diferent names in the (...) literature, such as ‘witnessing-sleep’ and ‘clear light sleep’ among others, the specifc phenomenological profle of this state has not yet been rigorously studied. This paper aims at presenting a preliminary investigation of objectless consciousness during sleep using a novel tool in qualitative research that can guide future research. Five participants experiencing objectless consciousness during sleep were interviewed following the Micro-phenomenological Interview technique (MPI; Petitmengin, 2005, 2006). All participants reported an experience they had during sleep in which there was no scenery and no dream. This period labelled as ‘No Scenery/Void’ was either preceded by the dissolution of a lucid dream or by other forms of conscious mentation. The analysis of the results advances four experiential dimensions during this state of void, namely (1) Perception of absence, (2) Self-perception, (3) Perception of emotions, and (4) Perception of awareness. While the results are primarily explorative, they refer to themes found in the literature to describe objectless sleep and point at potential avenues of research. The results from this study are taken as indications to guide future operationalisations of this phenomenon. (shrink)

In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. This volume bridges contemporary philosophical conceptions of risk and responsibility and offers an extensive examination of the topic. It shows that risk and responsibility combine in ways that give rise to new philosophical questions and problems. Philosophical interest in the relationship between risk and responsibility continues to rise, due in no small part due to environmental crises, emerging technologies, legal developments, and new medical advances. Despite such interest, scholars are just now working out how to conceive of the links between (...) risk and responsibility, the implications that risks may have to conceptions of responsibility (and vice versa), as well as how such theorizing might play out in applied cases. In this article I shall focus on the first three principles; I shall discuss various formulations of the principles (sect. 1), what it means for these theses to have the status of principles or axioms in Leibniz’s philosophy (sect. 2), the fundamental character of the Principles of Contradiction and (...) Sufficient Reason (sect. 3), some attempts to demonstrate the Principles of Contradiction and Sufficient Reason (sect. 4), and one attempt to demonstrate the Principle of Identity of Indiscernibles (sect. 5). Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

In this article I discuss one of the most significant areas of bioethical interest, which is the problem of moral enhancement. Since I claim that the crucial issue in the current debate on human bioenhancement is the problem of agency, I bring out and examine the conditions of possibility of self-understanding, acting subjects attributing responsible authorship for their actions to themselves. I shall argue that the very idea of moral enhancement, properly understood, fails to justify the claims that enhancing the (...) “biological” factor that plays a part in the process of making moral choices, whether through biomedical or genetic interventions, will actually increase the probability of having “morally better future motives”. What I would like to study is the presence of Cartesian manner of thinking in the Ricoeurian comprehension of subjectivity. I focus particularly on what is not saying expressis verbis in his argumentation. I do not say that the Ricoeurian conception of dialectical subject which is expressed as “oneself as another” places itself as continuation of the tradition of absolutization of cogito. By no means. Ricoeur’s investigation that pertains to subjectivity aims at elaborating its new formulation. Philosophy of Descartes might (...) be interpret in various ways not only as the synonym of “egology”. In my paper I indicate two formulas of ego which are included in Cartesian Meditations (ego cogito, ergo sum and ego sum, ego existo) that give rise to the different interpretations of ego. I analyse the Ricoeurian stance that relates to the consequences of introducing by Descartes the very formula ego sum, ego existo. In the second part I concentrate on issue on what sense rereading Meditations could be helpful in entering into discussion with structuralist critique of the subject. Also I get an approach to the theoretical framework of Ricoeurian argumentation which is established according to defend the subject. -/- W artykule staram się pokazać obecność elementów Kartezjańskiego sposobu rozumowania w Ricoeurowskim deklaratywnie „antykartezjańskim” ujęciu subiektywności. Nie twierdzę, że Ricoeur w proponowanej przez siebie koncepcji podmiotu dialektycznego wyrażonego jako "ten-który-jest-sobą-jak-i-innym" sytuuje sie po stronie tradycji absolutyzującej cogito. Moim celem jest przesledzenie tych momentów Ricoeurowskiej argumentacji prowadzonej na rzecz wypracowania nowej formuły podmiotowości, w których obecny jest (najczęściej implicite) wątek Kartezjański. W samej filozofii Kartezjusza obecna jest droga, która nie prowadzi do egologii. By pokazać dwie różne perspektywy odczytania Kartezjańskiego cogito, przywołuję dwie formuły: ego cogito ergo sum oraz ego sum, ego existo, by następnie poddac je analizie. W pierwszej cześci artykułu skupiam się na ukazaniu konsekwencji płynących z wykorzystania formuły ego sum, ego existo w dyskusji dotyczącej subiektywności. W drugiej cześci staram się dowieść, na jakiej drodze możliwe jest wykorzystanie Kartezjańskiej koncepcji podmiotu w konfrontacji ze strukturalistyczną krytyką podmiotu. (shrink)

In the Discourse on Metaphysics Leibniz put forward his famous complete-concept definition of substance. Sometimes this definition is glossed as stating that a substance is an entity with a concept so complete that it contains all its predicates, and it is thought that it follows directly from Leibniz’s theory of truth. Now, an adequate definition of substance should not apply to accidents. But, as I shall point out, if Leibniz’s theory of truth is correct then an accident is an entity (...) with a concept so complete that it contains all its predicates. The aim of this paper is to clarify Leibniz’s notion of substance in the Discourse with a view to explaining how that definition successfully distinguishes between substances and accidents. (shrink)

El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Por tanto, la tesis de fondo de este trabajo (...) es que, en la operación regular de los sistemas jurídicos del Civil Law, tanto los tribunales constitucionales y la jurisdicción en general identificaron la necesidad práctica de dotar de contornos a los derechos humanos —en tanto disposiciones jurídicas a concretar jurisdiccionalmente—. In the paper, the author asks whether what we have all heard over and over again of the “end of man” means the real end of man or, on the contrary, it has given rise to profound and necessary reevaluation of self-transparent subjectivity. The debate on the notion of selfhood has not been closed yet. The author analyses two different approaches to the problem. One pertains to the “self” that is taken as a monad. The other refers to dialogical theory (...) of selfhood which, as she tries to explain, one may regard as a way of overcoming the essential problem with the constitution of ourselves. According to this, the author claims that it is necessary to reconsider the claims of modern philosophy. She suggests that many of the objections that have been made against subjectivity derive from narrow view of philosophy in the 17th century. (shrink)

Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Este artículo trata de una inscripción constructiva omeya andalusí del año 387 / 4 enero 997-2 enero 998, hoy perdida, pero transmitida a través de un resumen castellano incluido en una lápida de 1259 "reparada" en 1575. Se intenta la restitución del texto árabe original y se estudian los hechos y los personajes documentados.

¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. (...) En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

Desde un esquema epistemológico sujeto-sujeto y desde un planteo feminista decolonial, nos acercará narrativas de mujeres mapuce que versan sobre la precarización de sus vidas y salud como parte de las violencias instituidas por la cultura hegemónica, poniendo sobre relieve la resiliencia de las culturas subalternizadas a partir de la lucha y re-existencia de estas mujeres.

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

Carbon offsetting remains contentious within, at least, philosophy. By posing and then answering a general question about an aspect of the morality of carbon offsetting—Does carbon offsetting make luxury emissions morally permissible?—this essay helps to lessen some of the topic’s contentiousness. Its central question is answered by arguing and defending the view that carbon offsetting makes luxury emissions morally permissible by counteracting potential harm. This essay then shows how this argument links to and offers a common starting point for further (...) examination of offsetting across various disciplines and domains, such as policy and other branches of philosophy like the ethics of risk. Recent years have seen a heightened focus on the study of minimal forms of awareness during sleep to advance the study of consciousness and understand what makes a state conscious. This focus draws on an increased interest in anecdotical descriptions made by classic Indian philosophical traditions about unusual forms of awareness during sleep. For instance, in the so-called state of witnessing-sleep or luminosity sleep, one is said to reach a state that goes beyond ordinary dreaming and abide in a state (...) of just awareness, a state in which one is not aware of anything else other than one’s own awareness. Moreover, for these traditions, this state is taken to be the essence or background of consciousness. Reports on such a state opens the door to exciting new lines of research in the study of consciousness, such as inquiry into the so-called “objectless” awareness during sleep—states of awareness that lack an ordinary object of awareness. In this two-staged research project, we attempted to find the phenomenological blueprints of such forms of awareness during sleep in 18 participants by conducting phenomenological interviews, informed by a novel tool in qualitative research, the micro-phenomenological interview (MPI) method. Following a phenomenological analysis, we isolated a similar phase across 12 reported experiences labelled as ‘nothingness phase’ since it described what participants took to be an experience of ‘nothingness’. his common phase was characterised by minimal sense of self—a bodiless self, yet experienced as being ‘somewhere’—, the presence of non-modal sensations, relatively pleasant emotions, an absence of visual experience, wide and unfocused attention, and an awareness of the state as it unfolded. Raymond Geuss asserts that there are fragmented views on what human rights are and that there is no unifying principle underlying such notion. I think that this view has its merits. It conveys the particularity of our perspectives, attitudes, desires and selfunderstandings. It rejects abstractness and is committed to a thick, perspectivist, historical understanding of personhood. To understand who we are, is to understand how we arrive at being who we are. By contrast, the notion of human rights deploys abstractness, (...) unification of agency, necessity and a thin view of personhood. In this paper, I attempt to bring into focus these two aspects of the notion of human rights. I will first analyse the genealogical method advocated by Geuss and argue that it has the merit of elucidating our historical contingencies; however, it is argued that any view in favour of the genealogical method relies on the idea that evaluative or normative concepts cannot be defined in terms of a common denominator. We reconstruct the Aristotelian idea of ‘focal meaning’ as core-resemblance and show that there is a unifying concept of human rights. We conclude that the perspectivist spirit of genealogy is not far from the Aristotelian tradition. Aristotle’s inquiry into a concept that could grasp different perspectives and contingencies as opposed to a Platonic understanding of abstract and universal forms shows that genealogical worries are germane to the tradition. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Advocates of interactionism in the ethical criticism of art argue that ethical value impacts aesthetic value. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...) actual agents, fictional artworks only have extrinsic ethical value. I show that what is at stake for interactionism is whether ethical judgements concerning artists’ attitudes in a context, rather than manifested attitudes, are ever aesthetically relevant. I conclude that, without buying into extreme actual intentionalism, a still controversial theory of interpretation that ties artworks’ meaning to actual artists, interactionism fails to show that ethical flaws/merits are aesthetic flaws/merits. In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. En este texto se presenta un espacio de intercambio de conocimientos desde una perspectiva científica, técnica y jurídica, para contribuir a la protección de los recursos naturales. Debido a la importancia de establecer mecanismos para proteger la biodiversidad y posibilitar la preservación de los conocimientos asociados especialmente al uso de la flora medicinal, la Línea de Investigación en Política y Legislación, del Grupo de Estudios en Sistemas Tradicionales de Salud de la Facultad de Medicina, y la Línea de Derecho Ambiental (...) y Grupos Étnicos, del Grupo de Derechos Humanos de Jurisprudencia de la Universidad del Rosario, desarrollaron este libro a través del cual la Universidad se propone profundizar en el panorama actual de la reglamentación y política –Internacional, nacional y local—respecto a la flora medicinal y al patrimonio cultural inmaterial asociado a ésta. En la vida democrática moderna la participación ha adquirido una importancia fundamental. La idea de la participación indirecta y del papel inactivo de las personas y de las comunidades mostró su carácter insuficiente para resolver las complejidades de los asuntos contemporáneos y las necesidades de las naciones. Los cambios que se han dado en los últimos tiempos proponen un Estado que se relaciona de manera más directa con el ciudadano, con el cual toma además las decisiones a través de procedimientos (...) de incidencia real y eficiente. La participación pasa a ocupar un puesto muy importante en la gestión del Estado, no solo en lo que tiene que ver con la toma de decisiones, sino también con la cogestión, el seguimiento y la evaluación de las mismas. Sin embargo, no basta con que el derecho a la participación sea reconocido: también se hace necesario el establecimiento de escenarios para su ejercicio como una obligación por parte del Estado. La participación es el cimiento del Estado y de la democracia; un deber y un derecho que se sustenta en el principio de solidaridad y en la unión de las comunidades en pos de un objetivo o de la integración de todas las personas en la construcción de un mejor país. El derecho a la participación es un derecho de primera generación correspondiente a los derechos civiles y políticos. En temas ambientales, una regla importante para orientar la actividad del Estado es la incidencia ciudadana en todos los ámbitos, desde las acciones de ordenamiento ambiental hasta las que tienen que ver con la investigación, con programas de control y protección de recursos, en el otorgamiento de licencias y permisos ambientales y en la planeación ambiental, entre otros. De esto se ha tenido conciencia desde la expedición del Código de Recursos Naturales en 1974, cuando se señaló que la actividad del Estado debería inducir a un manejo participativo, por cuanto se postula como regla de administración que debe promoverse la formación de asociaciones y de grupos cívicos para lograr la protección de los recursos naturales renovables y su utilización adecuada, con base en el estudio de las relaciones de la comunidad con tales recursos. Este proyecto responde a un momento histórico de gran importancia, que por supuesto no pudo ser más oportuno. Colombia celebra en el año 2006 los quince años de la promulgación de su Constitución Política, y los cambios de trascendentales surgidos a partir de su aplicación has sido prolíficos, Particularmente, el tema ambiental ha sobresalido dentro de las grandes transformaciones del país, y por ello no en vano hoy se afirma que tenemos una verdades Constitución ecológica. De igual forma, la Facultad (...) de Jurisprudencia de la Universidad del Rosario conmemora los die años de la creación de la especialización en Derecho Ambiental, y tal coincidencia histórica fue una motivación adicional para proponer la realización de un análisis de la evolución normativa surtida para proponer la realización de un análisis de la evolución normativa surtida en este decenio, una evaluación de la gestión ambiental colombiana y de sus distintos impactos en una sociedad que cuenta hoy en día con herramientas constitucionales legales para la defensa de sus derechos e interese colectivos. La Universidad del Rosario ha sido parte de esta evolución, desarrollando un rol activo con el cual se han abierto espacios de discusión y de proposición de alternativas, herramientas y experiencias en pro de la protección integral de la diversidad étnica, cultural y natural de la Nación colombiana. Así, se ha constituido como facilitadora del proceso de la formación de los nuevos actores y ha tenido gran posicionamiento en procesos de participación y de estructuración de proyectos institucionales ambientales.
